Hmmm… Medyo mahaba-haba itong sasabihin ko… It may not generally agree to what others are saying, but I would everyone to see the bigger picture and at the same time to let cooler heads prevail…
I would like to face this issue head on rather than doing some ad hominem attacks, as this issue tackles the most important law of the Philippines.
We need to consider the following points:
1. The 1987 Constitution was adopted after the fall of the Marcos dictatorship. The present constitution is remarkable in its protection of our human rights and freedom. Also, the present constitution has enough safeguards to prevent any other president from subverting democracy by stealth as what Marcos did. The protection against the suspension of the writ of habeas corpus and declaration of martial law is very elaborate. HOWEVER, since this constitution is tagged as the FREEDOM Constitution, any attempt to change the constitution, sincere or otherwise, rouses suspicions that it is the first step towards a slide back to dictatorship. This has been fed to the public by left-wing activists, civil societies and opposing politicians.
2. The timing of most attempts to change the constitution is always believed to be suspicious as it is always done by the allies of the reigning president and always towards the end of his/her term. You may want to check attempts done during the terms of the previous presidents.
3. The media has always been showing what the opposing parties to constitutional change has to say. It must be noted that what they are saying are also speculations. Most of them have the same color as most of those that support charter change. This time, they happen to stand at the opposing ends of the pole.
4. Advocates of the charter change say their main goal is for economic turn-around by removing constitutional restrictions on foreign investment. Others propose to replace the presidential system of government with a parliamentary system. They believe it would reduce endemic official corruption as well as help to quell the Muslim insurgency in Mindanao.
How should the constitutional change be done?
This is one weakness in our current constitution. There are two ways for charter change (cha-cha): constitutional convention (con-con) and constituent assembly (con-ass). For con-con, voters would elect representatives to the constitutional convention to consider changes. For con-ass, the move is to make the present Congress do the necessary changes.
Here comes the weakness. The current constitution is vague about how con-ass should be done (the provisions of the previous constitutions are non sequitur). It says that a con-ass would require the approval of three-quarters of Congress. HOWEVER, it does not explicitly say whether the Congress should vote as a whole body (congressman + senators) or separate houses: 18 of the 24 senators and three-quarters of the 238 members of the House, voting separately.
It must be noted however that Fr. Joaquin Bernas, a respected Constitutionalist and a member of the previous Constitutional Convention points to the records of the Convention that “the two houses of Congress vote separately” in reaching the required 3/4 vote.
If worse comes to worst, the Supreme Court will have to decide. This is the reason why the current resolution for con-ass was passed. The Lower House wanted the Supreme Court to clarify the Constitution.
Here are my points:
1. When national highways are named, the two houses vote separately. It seems illogical that when the need arises to vote for or against constitutional change, both houses will be combined. The senators would be clearly outnumbered. I don’t think the framers of the 1987 Constitution, with many legal luminaries, intended it that way, as pointed out by Fr. Bernas.
2. This exercise will still generate some good. It will empower the Supreme Court to clarify the Constitution, thus strengthen the institution and provide jurisprudence for future attempts.
3. This move should make us vigilant as a nation to make sure that our rights are not in any way infringed by the changes the con-ass will propose.
4. “Will propose”, because ultimately, the power to ratify the changes in the Constitution belongs to us, citizens of the Philippines. We will exercise this power through a plebiscite(this aspect is always left out by those rabid marchers in the streets).
Thus, the need to fully understand in one’s self the implication of the changes, the need to help others understand, and the need for vigilance to keep the sanctity of our votes, because the main protector of our rights under a democracy is the Constitution. If we allow it to be tampered, then we are at the mercy of those who are addicted to power.
5. I believe that this whole exercise will strengthen our democracy, if we allow the democratic process to take its course, and remain vigilant to protect that process to those who seek to tamper it for their own good.

Ikatlo. OO speculation naman talaga lahat yan e. Tanungin kita ulit, Ikaw ba hindi ka ba nagulat na magising ka na isang araw na naipasa agad ang HR 1109 ng hindi ka man lang nainform ng maayos tungkol sa uspaing ito? Ngayon masisisi mo ba ang tao kung mag speculate sila?
Ikaapat. Maraming naniniwala na may mga palya ang ating konstitusyon pero gusto nilang baguhin para maiwasan ang malawakang pangungurakot? Tantanan ako! At para maisaayos ang problema sa Mindanao? Bakit hindi ba puedeng maisayos yan sa ating konstitusyon ngayon? Precisely the general observation. The timing of the proposals for constitutional changes are always toward the end of a president’s term by the allies of the president. This also happened during the time of President Ramos. And I was one of those who were out on the streets.
Response to your 3rd point:
I was not surprised because I was vigilant from the beginning. I followed the issue and allowed myself to be properly informed. The mature way of dealing with this is to rise above the ad hominem issues (corrupt leaders, buwaya, swapang, etc…) and confront the pros and cons head on. I listened to the radio the whole night that the Lower House was debating to pass HR1109. Speculation has always played a bad role in our country’s politics. This is because we would rather join the bandwagon rather than being vigilant and to understand the issues. We would rather rave and be angry than to think and discuss as mature persons. We should refrain from personality politics if we want to get out of the mire we are in.
We forget one important essence of democracy – leaders are elected by the majority. Democracy is full of sweet ironies. Inasmuch as we can say whatever we want, we should also submit to the majority and we should learn to respect collective wisdom. Leaders in the Lower House were elected by their own constituents. Their constituents decided that these persons will speak in their behalf. That we should respect.
To continue such respect and and at the same time tackle the issues at hand, we should rise above the personal level and tackle issues in the intellectual level.
Response to your 4th point:
The rush in doing the change as I said I also find questionable. As of the moment, the main thrust for the constitutional change is still for the change in government from presidential to parliamentary. Most legal minds believe that the system of government would play an important role for our country to move forward. Ergo, the change in government system necessitates a change in our constitution. As to how this will address corruption and peace in Mindanao, search over the internet the document written by Jose V. Abueva, Chairman of the Consultative Commission for Constitutional Change in 2005. It is entitled “WHY CHANGE OUR PRESIDENTIAL GOVERNMENT TO A PARLIAMENTARY GOVERNMENT?”
While we remain to be vigilant, it pays off to understand the concrete issues. And as I have emphasized, the approval of the changes in the constitution all boils down to us, not to the congressmen… They will only propose, we will decide. Thus, the need to be informed and to rise above personality politics, for pitiful is the man who doesn’t know the other side of the coin.

Hindi sila ang magdedesisyon kapatid… Tayo… Yesterday, the Supreme Court denied all motions calling for the latter to intervene and stop the Lower House with its move towards ConAss. The move of the Supreme Court I believe was one of irritation… I am quoting the Manila Times article here:

1. I believe that the constitution needs changes. As to when is the proper time to change, any time. It doesn\’t matter anyway, there will always be opposers at any given day. It is necessary that we keep ourselves abreast with the proposed changes. It is important that our rights are not diminshed or compromised in any way.
2. The constitutional change should follow due process.
3. I do not want to speculate on any politician\’s motive. It is basically their right. If they seek re-election and will be re-elected, it is their constituents\’ voice that will prevail and not mine. That is democracy. To dictate on them is trampling on their rights.
4. It is my right to understand the issues and changes, and to let my opinion be heard when the time comes. It is also my duty to protect my opinion and those of others if they be cast in a vote.

alam mo daw kung bakit nila minamadali? di ko pa na research kung sino ang may sabi pero ang sabi nitong “tongressman” na ito ay diumano nagpasa na daw sila nung first years of GMA’s term pero turned down then they tried it daw again for d second time, ganun pa din daw. pero ngayong last na inihain nila ay ngayon lang daw na aapproved. naguluhan ako kasi bakit niya idinahilan yun? so ibig sabihin frustrated na ba talaga sila kaya bigla ipinasa iyan? sapilitan na ba ito? Hindi ko alam ang sagot kasi hindi ako marunong mag madyik. hay.. ewan ko sa kanila. pero lahat yan magkakaron din ng sagot soon. at katulad nga ng sinasabi ko kapag nadiscover ng masa ang balak nila soon e di ko na lang alam kung anu mangyayari.

The most difficult stumbling block of effecting change is when we face paradigms of legacy… (this concept is based on corporate Lean Six Sigma). The only way to get through is to be able to understand HOW the entire process should go about.
Applied to constitutional change, many people say “baka nabago na ang constitution, hindi pa natin alam”. That I believe, and forgive the word, is preposterous. There are also some who say “kung babaguhin nila, ipa-alam nila”. Again, forgive me, that is also ridiculous… This is the stumbling: many people do not know the process of changing the constitution.
I am not a lawyer (aspiring lang). For me to be able to keep up with this issue to use my mind properly and not mere emotional outbursts, I studied the process…
When Senate and Lower House do eventually convene to change the constituion (which is still a far thing to happen, with the legal stumbling block the Lower House has to overcome in case it goes ahead without the Senate), their changes will have to be published nationwide. This is what happened in 1987. In fact, my father still has his copy. Everyone will be given the chance to read and study the changes… After that, a referendum will happen to vote for or against the changes.
With the changes affecting everyone in the country, at these times, with the different forms of broadcast and info media, IT IS IMPOSSIBLE for constitutional changes to go unnoticed and eventually be ratified into law… If you are of voting age, it will also be IMPOSSIBLE not to know this since you will be called upon to vote, unless you are irresponsible and indifferent enough not to know about the referendum.
We must study these things first before we go rabidly ranting our dislikes and suspicions – for little learning is dangerous.
As a responsible citizen, one need not wait for congressmen (or tongressmen as most prefer to call them) to explain the changes, why there is that need, how will the changes help to feed hungry mouths and other endless rants. Responsible citizens ACT PROACTIVELY. They responsibly seek to answer their own questions rather than rant. Each opposing view should be considered and studied. And they will eventually cast their vote.
I would like to share my favorite political maxim: A NATION CANNOT RISE ABOVE THE CONSCIOUSNESS OF ITS PEOPLE. Our country’s current state is of our own making as a people. If we go own complaining, we have no one to blame but ourselves for we have contributed to the state it is in.
For changes to happen, we must follow the laws. Sabi nga ni Mr. Alex Lacson, kailangan lang natin magsimula sa simpleng bagay, gaya ng pagsunod sa batas trapiko…
For changes to happen, we should take it upon ourselves the yoke of nation building. Hindi tayo dapat umasa na lang parati sa ating mga leaders. It might be as simple as saving for a can of soft drink a day.
For changes to happen, we must study how democratic processes go. And we must involve ourselves reponsibly in them.
Lastly, if we want a better Philippines, it takes an amount of self-sacrifice. It takes much more than just paying taxes. Even those who have no love for our country pay their taxes. So, what have we done lately to make Philippines a better country?
Bottomline, no matter how often we change our constitution, if we stay in our complaining state of mind as a people, no positive change will happen.
